OPINION This is an appeal from a superior court judgment affirming the denial, without hearing, of Mark Noden's application for a limited entry permit by the Commercial Fisheries Entry Commission (CFEC). Noden raises two issues on appeal: (1) whether the Commission abused its discretion by failing to interpret a letter from him as a request for a hearing; and (2) whether he was inadequately provided with the right to a hearing in violation of the due process clauses of the Alaska and United States Constitutions.
