Mark Smith was convicted, based upon his plea of nolo contendere, of criminal negligent homicide, AS 11.41.130, a class C felony, and failure to render assistance after an injury accident, AS 28.35.060(a), an unclassified felony with a maximum sentence of ten years. Superior Court Judge Gerald J. Van Hoomissen sentenced Smith, a first-felony offender, to five years on the homicide charge and to ten years with five years suspended on the failure to render assistance charge. These sentences are concurrent. Smith appeals, arguing that his sentence is excessive. We conclude that Smiths sentence is excessive, and remanded for imposition of a sentence not to exceed four years.
